1. Agreement to Terms
These Terms and Conditions govern your use of the website and mobile application (together, the Platform) operated by Margaret Bowen MD PLLC, doing business as Restoration is a Journey (RIAJ). By creating an account, booking an appointment, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
These Terms should be read together with our Privacy Policy, which explains how we collect and use your information.
2. Who Can Use the Platform
The Platform is intended for adult patients aged 18 and older who are located in North Carolina or Virginia. By using the Platform, you confirm that you are at least 18 years old and that you are located in one of these states at the time you receive services.
3. What the Platform Does
The Platform allows you to:
- Request and manage appointments with RIAJ
- Communicate with clinic staff
- Attend telemedicine visits through Google Meet
- Receive appointment reminders and updates by email and, if you opt in, by text message
The Platform does not process payments. RIAJ does not charge patients through the website or app. Billing and insurance matters are handled directly by clinic staff outside of the Platform. If we introduce online payment processing in the future, these Terms will be updated to describe it.
4. Not for Emergencies
The Platform and our telemedicine services are not intended for medical emergencies. If you are experiencing a medical emergency or a crisis involving risk to yourself or others, call 911 or go to the nearest emergency room. You can also reach the 988 Suicide and Crisis Lifeline by calling or texting 988.
5. Telemedicine Consent
By scheduling and attending a telemedicine visit, you acknowledge and agree to the following:
- Telemedicine visits are conducted using Google Meet. You are responsible for having a working internet connection, camera, and microphone.
- Video and audio quality can be affected by your internet connection or device, and a session may occasionally need to be rescheduled if a technical issue prevents effective care.
- Telemedicine has some limitations compared to an in-person visit. Your provider will let you know if your condition requires an in-person appointment instead.
- You are responsible for being in a private location during your telemedicine visit to protect your own confidentiality.
6. Text Message (SMS) Consent
If you provide your phone number, you consent to receive text messages from RIAJ related to appointment confirmations, reminders, and similar updates. These messages may be sent through an automated system. Message and data rates may apply depending on your mobile carrier. Providing a phone number is optional and is never required to book an appointment.
You can opt out of text messages at any time by replying STOP to any message you receive. Opting out of text messages will not affect your ability to use the Platform or receive care.
7. Your Account
You are responsible for keeping your account login information confidential and for all activity that occurs under your account. Notify us immediately if you believe your account has been accessed without your permission. You agree to provide accurate and current information when creating your account and to keep it up to date.
8. Acceptable Use
When using the Platform, you agree not to:
- Provide false information about your identity or health information
- Use the Platform to harass, threaten, or abuse clinic staff or other users
- Attempt to access another patient's account or records
- Interfere with or disrupt the operation of the website or mobile app
- Use the Platform for any purpose other than seeking or coordinating your own healthcare
We may suspend or terminate your access to the Platform if we believe these Terms have been violated.
9. Intellectual Property
The website, mobile app, and all associated content, branding, and design are the property of Margaret Bowen MD PLLC and may not be copied, reproduced, or used without our written permission, except as necessary for your normal use of the Platform as a patient.
10. Third-Party Services
The Platform relies on third-party services, including Google Meet for telemedicine visits and Amazon Web Services for hosting. Your use of these services through our Platform is also subject to the applicable third-party terms, and we are not responsible for outages or issues caused by these third-party providers, though we work to minimize any impact on your care.
11. No Warranty
The Platform is provided on an "as is" basis. While we work to keep the website and app available and functioning correctly, we do not guarantee that the Platform will always be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, Margaret Bowen MD PLLC is not liable for indirect, incidental, or consequential damages arising from your use of the Platform, other than as related to the professional healthcare services you receive from the clinic, which are governed by applicable medical malpractice and healthcare law rather than these Terms.
13. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Platform after a change means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.
